NEWS: Karnataka Labour Department clarified that safeguards for women working night shifts—previously provided under the Shops and Commercial Establishments Act—are incorporated, where applicable, under the Occupational Safety, Health and Working Conditions (OSH) Rules.
Key Safeguards
- Consent → Written consent of the woman employee is required for night-shift work.
- Transport → Adequate, free transport must be provided for pick-up + drop-off at her residence.
- Workplace safety → Safe, secure and healthy working conditions; adequately illuminated pathways, toilets, washrooms and drinking-water facilities.
- Emergency support → Dedicated telephone numbers must be displayed prominently; safe entry and exit facilities must be available.
- Staffing → At least four women employees must be on duty at any workplace.
- Legal protection → Maternity-benefit provisions and the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 must be complied with, wherever applicable.
Coverage
- Establishments employing 10 or more workers generally fall under the OSH Code, subject to its applicability.
- Establishments employing fewer than 10 workers may continue to be covered by the Karnataka Shops and Commercial Establishments Act.
- The State Government may prescribe additional conditions for women employees’ safety and welfare.
