NEWS – The Union Ministry of Home Affairs (MHA) has notified the Immigration and Foreigners Rules, 2025, under the Immigration and Foreigners Act, 2025. The rules give legal powers to the Bureau of Immigration (BOI) to deal with immigration fraud and manage the movement of foreigners in India.

HIGHLIGHTS

1. Role of the Bureau of Immigration (BOI):

• BOI is legally empowered to investigate immigration fraud, coordinate with States, and deport or restrict foreigners.
• Previously, BOI had similar responsibilities, but these were not codified in law.

2. Biometric Data Collection:

• For the first time, the rules mandate recording biometric information of all foreigners, not just selected visa categories.
• This will help in tracking and identifying foreigners more effectively.

3. Responsibilities of Educational Institutions:

• Schools, colleges, and universities must report all foreign students to the Foreigners Regional Registration Office (FRRO).
• Institutions need to provide semester-wise updates on academic performance, attendance, and general conduct.

4. Powers of Civil Authorities:

• Civil authorities can shut down premises (resorts, clubs, entertainment venues) frequented by undesirable foreigners or illegal migrants.
• Premises can also be closed if operated in a disorderly or harmful manner.
• Owners cannot open new premises without approval.

5. Role of Airlines and Immigration Officers:

• Airlines and sea-carriers must submit passenger and crew details to BOI 15 minutes before departure.
• Immigration officers, provided by the Intelligence Bureau, will enforce these rules.

• Ensures legal tracking of foreigners and prevents misuse of visas.
