Key Provisions of the Draft Bill

  1. a) Written Agreement
  • Mandatory written agreement between employer and domestic worker.
  • Violation: Punishable with up to 3 months’ imprisonment.
  1. b) Definition of Domestic Worker
  • Anyone employed for domestic work directly, indirectly, through contract or digital platform.
  • Includes part-time, full-time, casual, temporary, gig, and migrant workers.
  1. c) Definition of Employer
  • Any person engaging domestic workers directly or through agencies/platforms.
  • Includes head of household or person with control over the premises.

 Work Conditions and Rights

  • Weekly limit: Maximum 48 working hours.
  • Leave: One full-day holiday or two half-day holidays per week.
  • Entitlements: Reasonable work hours, rest periods, annual leave, and maternity benefits.
  • Minimum and overtime wages are mandatory.

 Registration Requirements

  • Domestic workers and employers must register within one month of employment.
  • For illiterate or migrant workers, registration must be ensured by the employer or placement agency.
  • Any change in employment or migration must be reported within 30 days.

Welfare Measures

  1. a) Welfare Board
  • Establishment of the Karnataka State Domestic Workers Social Security and Welfare Board.
  • Tri-partite composition: Domestic workers, employers, service providers, and government officials.
  1. b) Welfare Fund
  • Financed through:
    • Registration fees,
    • Up to 5% cess from employers,
    • Fines, and
    • Government grants.

Penalties

  • 3–7 years imprisonment + ₹50,000 fine for:
    • Sending workers for immoral purposes,
    • Abuse or illegal confinement,
    • Employing child domestic workers.

Significance

  • Aims to formalize the unorganized domestic sector,
  • Ensures social security, fair wages, and dignity of labour,
  • Sets a model for other states to adopt similar welfare frameworks.
