The Constituent Assembly of India was tasked with drafting the Indian Constitution post-independence. While it successfully completed this mission, it faced several criticisms from various quarters. The critics raised concerns about its representative nature, functioning, and composition. Below are the key criticisms often highlighted.
Constituent Assembly was not directly elected by the people of India. The method of electing members was not based on universal adult franchise which was seen as a flaw in the democratic legitimacy of the Assembly.
As it created under the Cabinet Mission Plan, assembly was criticized as product of British authority and not truly soverign
It was claimed the work of the assembly was time consuming. The Constituent Assembly took nearly three years (1946-1949) to complete the drafting of the Constitution. American Constitution was drafted in four months, leading to accusations of inefficiency.
The Assembly was predominantly led by Congress members, creating a perception of political bias. According to British scholar Granville Austin this limited the diversity of political views.
Lawyers and politicians dominated the Assembly, with limited representation from other sectors of society like farmers, laborers, and women. It was said Constitution was made complex because of its legalistic language.
Some detractors, like Winston Churchill and Lord Simon, claimed that the Assembly was Hindu-majority, neglecting the diversity of India's population, especially the Muslim and minority communities.
Despite facing criticisms, the Constituent Assembly of India successfully drafted a progressive and inclusive Constitution that has withstood the test of time. While limitations existed, such as the lack of direct elections and dominance of lawyers and politicians, the Constitution's framework has proven resilient and adaptable. The Indian Constitution's enduring legacy demonstrates that its strengths have effectively overcome its limitations, establishing a robust foundation for India's growth and development.
